Paragraph 3 of the s. 73 of the Charter of the French language is declared invalid. The effect of this declaration is suspended for one year from the date of this judgment, but, despite this suspension, the file is returned to the person designated by the Quebec Minister of Education to immediately issue a certificate of eligibility for instruction in English for Satbir Bindra.
The constitutional questions are answered as follows:
(1) Does the third paragraph of s. 73 of the Charter of the French language, R.S.Q., c. C-11, infringe s. 23(2) of the Canadian Charter of Rights and Freedoms?

(2) If so, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?

The motions for leave to intervene of the Quebec Provincial Association of Teachers, the Association Franco-ontarienne des conseils scolaires catholiques and the Commission scolaire francophone, Territoires du Nord-Ouest are granted and the said interveners shall be entitled to each serve and file a factum not to exceed 10 pages in length on or before November 13, 2008, in the following appeal: Ministre de l'Éducation, du Loisir et du Sport, et al. v. Hong Ha Nguyen, et al (32229).
The requests to present oral argument are deferred to a date following receipt and consideration of the written arguments of the parties and the interveners.
The interveners shall not be entitled to raise new issues or to adduce further evidence or otherwise to supplement the record of the parties. Interveners with similar or identical interests should attempt to avoid duplication.
Pursuant to Rule 59(1)(a) of the Rules of the Supreme Court of Canada, the interveners shall pay to the appellants and respondents any additional disbursements occasioned to the appellants and respondents by their intervention.
