Judgment on the appeal rendered, Ka Côt Br Row Kas, The appeal from the judgment of the Court of Appeal for Ontario, Number C66431, 2022 ONCA 155, dated February 22, 2022, was heard on November 9, 2022, and the Court on that day delivered the following judgment orally: KASIRER J. — A majority of the Court would allow the appeal. The trial judge’s instructions for Mr. Doxtator properly left with the jury the reasonably available verdicts. As MacPherson J.A., dissenting, correctly observed in the Court of Appeal, the trial judge explicitly instructed the jury to consider Mr. Doxtator’s case separately from that of the co-accused. Nothing in the record on appeal permits this Court to depart from the assumption that juries generally follow explicit instructions: see R. v. Corbett, [1988] 1 S.C.R. 670, at pp. 692-93. This is sufficient for the appeal to be allowed, to set aside the order for a new trial for the respondent Richard Doxtator and to restore his conviction for first degree murder. Justices Karakatsanis and Rowe, dissenting, would dismiss the appeal substantially for the reasons of Roberts J.A. in the Court of Appeal. Allowed |

The respondent, Richard Doxtator, along with his co-accused Jasmine Doxtator, were both convicted of first degree murder by a judge sitting with a jury.
Before the Ontario Court of Appeal, they appealed their convictions and requested a new trial. They submitted that the trial judge erred in failing to leave for the jury’s consideration for Jasmine Doxtator, the included offences of second degree murder and manslaughter. If a new trial was ordered for Ms. Doxtator, they submitted that the respondent should also have one as their cases are intertwined. A majority at the Court of Appeal agreed that the included offences should have been left with the jury for Ms. Doxtator and ordered a new trial for both accused. The majority concluded that the failure to leave second degree murder and manslaughter for Ms. Doxtator narrowed the instructions for the respondent and weakened his position that he was not guilty of first degree murder. As a result, it could not be said the verdict for the respondent would have been the same.
MacPherson J.A. agreed with the majority regarding the disposition of Ms. Doxtator’s appeal, but would have dismissed the respondent’s appeal. She disagreed that the failure to put second degree murder and manslaughter to the jury for Ms. Doxtator negatively impacted the respondent’s charge.
